GLS Campus Hotel Berlin –
Terms & Conditions
I. Scope of Application
- These Terms and Conditions apply to contracts for the rental of hotel rooms for lodging, as well as to all other services and deliveries provided by the hotel to the customer.
- The subletting or re-renting of the rooms provided, as well as their use for purposes other than lodging, require the hotel’s prior written consent.
- The customer’s terms and conditions shall apply only if this has been expressly agreed to in writing in advance.
II. Conclusion of the Contract, Statute of Limitations
- The contract is concluded upon the hotel’s acceptance of the customer’s request. The hotel is free to confirm the room reservation in writing.
- All claims against the hotel generally become time-barred one year after the start of the regular statute of limitations period under § 199(1) of the German Civil Code (BGB), which is contingent upon the hotel’s knowledge of the claim. Claims for damages become time-barred after five years, regardless of whether the hotel has knowledge of the claim. The shortened statute of limitations periods do not apply to claims based on an intentional or grossly negligent breach of duty by the hotel.
III. Services, Prices, Payment, Set-off
- The hotel is obligated to reserve the rooms booked by the customer and to provide the agreed-upon services.
- The customer is obligated to pay the hotel’s applicable or agreed-upon prices for the room rental and any additional services utilized by the customer upon departure. This also applies to services arranged by the customer and expenses incurred by the hotel on behalf of third parties.
- For group bookings, security deposits must generally be provided—unless otherwise agreed in writing—as follows: 80% of the total price upon conclusion of the contract. After the stay, a final total invoice will be issued and sent. The remaining invoice amount is due within 14 days of departure.
- The agreed-upon rates include the applicable statutory value-added tax. If the period between the conclusion of the contract and its fulfillment exceeds four months and the price generally charged by the hotel for such services increases, the hotel may raise the contractually agreed-upon price appropriately, but by no more than 5%.
- The hotel may also change the prices if the customer subsequently requests changes to the number of rooms booked, the hotel’s services, or the length of the guests’ stay, and the hotel agrees to such changes.
- Hotel invoices without a due date are payable in full upon commencement of services. The hotel is entitled to declare accrued claims due at any time and to demand immediate payment. In the event of late payment, the hotel is entitled to charge the applicable statutory default interest, currently 8% or, in the case of legal transactions involving a consumer, 5% above the base interest rate. The hotel reserves the right to prove that it has suffered greater damages.
- The hotel is entitled, upon conclusion of the contract or thereafter, taking into account the legal provisions governing package tours, to demand a reasonable advance payment or security deposit. The amount of the advance payment and the payment dates may be agreed upon in writing in the contract.
- The customer may set off or reduce a claim against the hotel only with an undisputed or legally enforceable claim.
IV. Cancellation and Number of Guests for Individual Bookings
- For individual bookings, cancellation is possible up to 24 hours prior to arrival without triggering any payment or compensation claims by the hotel, unless otherwise specified in the contract, e.g., non-refundable rates or similar.
- A cancellation must always be made in writing and is only considered confirmed if the hotel confirms it in writing. Cancellations by telephone will not be accepted.
- In the event of a cancellation after this deadline, the hotel is entitled to the contractually agreed-upon compensation, less any expenses saved. This does not apply in the event of a breach by the hotel of its obligation to respect the customer’s rights, legal interests, and interests, if the customer can no longer reasonably be expected to remain bound by the contract as a result, or if the customer is entitled to any other statutory or contractual right of withdrawal. The hotel reserves the right to apply a flat-rate deduction for expenses saved.
- Accordingly, in the event of cancellation or no-show, the customer is obligated to make the following payments:
• 24 hours or less before arrival or in the event of a no-show: 90% - If the customer books through a third-party provider (e.g., hotel booking sites such as Booking.com, HRS, Expedia, or similar), the customer is obligated to process any changes or cancellations directly through that provider.
V. Cancellation and Number of Guests for Group Bookings
For group bookings of 8 or more rooms, the following cancellation policy applies:
- Up to 6 weeks prior to arrival, the entire number of room nights may be canceled free of charge (for 35 or more rooms, free cancellation up to 8 weeks prior to arrival; for 50 or more rooms, free cancellation up to 12 weeks prior to arrival).
- Up to 4 weeks prior to arrival, up to 50% of the room nights may be canceled free of charge (for 35 or more rooms, up to 6 weeks; for 50 or more rooms, up to 10 weeks prior to arrival). The remaining 50% of the canceled rooms will be subject to a 90% cancellation fee.
- Up to 2 weeks before arrival, up to 25% of the room nights can be canceled free of charge (for bookings of 35 rooms or more, up to 4 weeks; for bookings of 50 rooms or more, up to 8 weeks before arrival). The remaining 75% of the canceled rooms will be charged a 90% cancellation fee.
- Up to 1 week before arrival, up to 10% of the room nights may be canceled free of charge. The remaining 90% of the canceled rooms will be subject to a 90% cancellation fee.
- For all room nights from group bookings canceled less than 1 week before arrival, a 90% cancellation fee will be charged.
Additional room nights beyond the contractually agreed-upon quota can only be confirmed in writing and will then be offered at the current daily group rate.
A cancellation must always be made in writing and is only considered confirmed if the hotel has confirmed it in writing. Cancellations made by phone will not be accepted.
An increase in the number of guests or rooms requires confirmation from the hotel.
VI. Withdrawal by the Hotel
- If a right of withdrawal free of charge for the customer within a specified period has been agreed upon in writing, the hotel is, for its part, entitled to withdraw from the contract during this period if there are inquiries from other customers regarding the contractually booked rooms and the customer does not waive their right to withdraw upon the hotel’s request.
- If an agreed-upon advance payment—or one required pursuant to Clause III, Nos. 6 and 7 above—is not made even after the expiration of a reasonable grace period set by the hotel, the hotel is also entitled to withdraw from the contract.
- Furthermore, the hotel is entitled to terminate the contract for cause for objectively justified reasons, for example if
- force majeure or other circumstances beyond the hotel’s control render fulfillment of the contract impossible
- hotel rooms are booked based on misleading or false statements regarding material facts, e.g., regarding the guest’s identity or the purpose of the stay;
- the hotel has reasonable grounds to believe that the use of the hotel’s services or the event may jeopardize the smooth operation of the business, the safety, or the hotel’s public reputation, without this being attributable to the hotel’s sphere of control or organizational responsibility;
- there is a violation of Clause I, No. 2 above.
4. In the event of a justified cancellation by the hotel, the customer shall have no claim for damages.
VII. Room Provision, Handover, and Return
- The customer has no right to the provision of specific rooms.
- Booked rooms are available to the customer starting at 3:00 p.m. on the agreed-upon arrival date. The customer has no right to earlier access.
- On the agreed departure date, the rooms must be vacated and made available to the hotel by 11:00 a.m. at the latest. Thereafter, due to the delayed vacating of the room, the hotel may charge 50% of the full room rate (list price) for its use beyond the terms of the contract until 3:00 p.m., and 100% from 3:00 p.m. onward. This does not give rise to any contractual claims on the part of the guest. The guest is free to prove that the hotel incurred no claim for usage fees or a significantly lower claim.
- Smoking is not permitted anywhere in the hotel. If smoking occurs in a hotel room, the hotel reserves the right to charge €100 in damages.
- Carrying weapons is prohibited on the entire premises. Failure to comply will result in a ban from the premises.
- The reservation and provision of hotel parking spaces are subject to availability. Reserved parking spaces are available from 3:00 PM on the day of arrival until 11:00 AM on the day of departure. The same cancellation policy applies to pre-booked parking spaces as to the rooms.
VIII. Liability of the Hotel
- The hotel is liable for its obligations under the contract with the diligence of a prudent businessman. Claims by the guest for damages are excluded. Exceptions to this are damages resulting from injury to life, limb, or health if the hotel is responsible for the breach of duty; other damages resulting from an intentional or grossly negligent breach of duty by the hotel; and damages resulting from an intentional or negligent breach of the hotel’s duties typical to the contract. A breach of duty by a legal representative or vicarious agent of the hotel shall be deemed equivalent to a breach by the hotel itself. Should disruptions or defects in the hotel’s services occur, the hotel shall endeavor to remedy the situation upon becoming aware of the issue or upon immediate notification by the customer. The customer is obligated to make a reasonable effort to help resolve the disruption and minimize any potential damage.
- The hotel is liable to the guest for items brought onto the premises in accordance with statutory provisions, up to one hundred times the room rate, with a maximum of €3,500, and for cash, securities, and valuables up to €800. Cash and valuables may not be stored in the hotel safe.
- Claims for liability shall lapse unless the guest immediately notifies the hotel upon becoming aware of any loss, destruction, or damage (Section 703 of the German Civil Code (BGB)). For any further liability on the part of the hotel, the second through fourth sentences of paragraph 1 above shall apply accordingly.
- To the extent that a parking space is made available to the guest in the hotel garage or in a hotel parking lot—even for a fee—this does not constitute a contract of safekeeping. The hotel is not liable for the loss of or damage to motor vehicles parked or maneuvered on the hotel premises or their contents, except in cases of willful misconduct or gross negligence.
The foregoing
paragraph 1, sentences 2 through 4, apply accordingly. - Wake-up calls are handled by the hotel with the utmost care. Messages, mail, and packages for guests are handled with care. The hotel assumes responsibility for the delivery, safekeeping, and—upon request—forwarding of such items for a fee. The foregoing paragraph 1, sentences 2 through 4, apply accordingly.
- Use of the swimming pool, sauna, and fitness room is at the guest’s own risk.
- Bicycle batteries may not be charged in the room.
IX. Bed Tax
Effective January 1, 2014, the State of Berlin levies an overnight stay tax on the cost of paid overnight stays in Berlin at a lodging facility. An “overnight stay” is defined as the paid reservation of overnight accommodations, regardless of whether the guest actually stays there. Canceling a contractually agreed-upon overnight stay before it is utilized does not trigger taxation, as the accommodation was not actually provided.
X. Filming and Photography
Commercial photo shoots, film shoots, or other video and audio recordings are permitted only by prior arrangement—different daily rates may apply in such cases. Content that violates the law or is unethical—including material that is pornographic, far-right, racist, discriminatory, sexist, satanic, glorifies violence, is offensive, defamatory, damaging to business or reputation, or otherwise unacceptable—is prohibited. The location must be left in the same condition as it was found.
XI. Final Provisions
- Any amendments or additions to the contract, the acceptance of the reservation, or these Terms and Conditions for Hotel Accommodation must be made in writing. Unilateral amendments or additions by the customer are invalid.
- The place of performance and payment is the hotel’s registered office.
- German law applies exclusively to the entire legal and contractual relationship between the customer and the hotel. The application of the UN Convention on Contracts for the International Sale of Goods and conflict-of-laws provisions is excluded.
- For legal actions brought by the hotel against the customer, the customer’s place of residence shall be the determining factor. For legal actions against customers or contractual partners under the travel contract who are merchants, legal entities under public or private law, or persons whose place of residence or habitual abode is abroad, or whose place of residence or habitual abode is unknown at the time the action is filed, the place of jurisdiction shall be the hotel’s registered office.
- The foregoing provisions do not apply if and to the extent that international agreements or EU regulations mandatorily provide otherwise in favor of the customer.
Severability Clause
Should individual provisions of these General Terms and Conditions be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. In the event of legal disputes, Berlin, the provider’s place of jurisdiction, shall be the governing jurisdiction.
